This anticipatory bail application under Section 482 of the

BNSS (438 Cr.P.C.) has been filed by the petitioner apprehending

his arrest in connection with FIR No.133/2024, registered at Police

Station Chitalwana, District Jalore for the offences under Sections

126(2), 115(2), 78(2), 140(3), 308(2), 70(1), 79 and 3(5) of the

BNS.

Learned counsel for the petitioner submits that the petitioner

has not been named in the FIR nor in the statement of the victim

‘S’ (aged about 18 years) recorded before the competent Criminal

Court under Section 183 and 180 of the BNSS. He submits that

the allegation are primarily against Vikas and Durgaram, and that

the petitioner had no active role to play in the said incident. He

further submits that a compromise has arrived at between the

petitioner and victim ‘S’ and in this regard a copy of the affidavit

executed by the victim ‘S’ and her mother Bidami Devi has been

placed on record. He contends that in this affidavit complainant

has categorically stated that she does not want to continue the

proceeding against the petitioner. Thus, no fruitful purpose would

be served by sending the petitioner behind the bars.
