1. In this petition filed under Section 528 of BNSS, 2023, the
petitioner seek a direction for to expedite the proceedings of a
criminal complaint under Section 200 of CrPC in Criminal Case
(filing No.) No. 2191/2022 pending before the learned Judicial
Magistrate First Class (JMFC), Korba (C.G.).

2. Facts of the case are that on 13.04.2022, the Petitioner
participated in a peaceful agitation, at Parsabhatha Gate,
protesting wage disparities and workers’ rights violations by
BALCO. On 18.04.2022, BALCO through its representative
Prateek Jain, filed an application before the Labour Court,
Korba, alleging the agitation was illegal and submitting forged
Standing Orders to obtain an ex-parte injunction on
22.04.2022. The Labour Court, upon reviewing the documents,
found them to be forged on 06.05.2022, and warned BALCO
against future misconduct. Aggrieved by BALCO’s actions, the
Petitioner filed a complaint in the Balco Nagar Police Station on
17.05.2022, which was not acted upon. Consequently, the
Petitioner filed a Criminal Complaint (Filing No. 2191/2022)
under Section 200 CrPC on 26.09.2022, before the JMFC,
Korba, alleging offences under IPC Sections 420, 467, 468, and
471.
3. The learned counsel for the Petitioner submits that the case has
been pending before the trial court for arguments on pre-
registration since 21.02.2023, and the proceedings are
progressing at a slow pace over the past 2.5 years. Therefore,
the counsel prays for a direction to the trial Court, to conclude
the proceedings as expeditiously as possible.
4. I have heard learned Counsel appearing for the Petitioner and
perused the documents annexed with the petition including the
order sheets of the Trial Court.
5. Upon perusal of the records, it is evident that the complaint

case has been pending since 21.02.2023, and has been
adjourned for argument, with no progress made for about 2.5
years and in view of the limited prayer made in this petition,
without commenting on the merits of the case, this Court
directs the concern Court to expedite the proceedings in
Criminal Case (filing) No. 2191/2022.
6. With the above observations/direction, this petition stands
finally dispose off at the admission stage itself.
