Vide Order dated 4th of December, 2024, having regard to the
pitiable condition in which the Petitioner has been subjected to by the
Respondents, despite an Order in his favour passed in SWP No. 391/2001
on 5th of March, 2015 with regard to his appointment against the post of
Cultural Assistant (Tabla Player) in the Department of Information,
Government of Jammu & Kashmir on his deemed relaxation of age as well,
this Court had directed the Secretary, Information Department, Government
of Jammu & Kashmir, to appear in person before the Court with the
appointment Order of the Petitioner, failing which the Court shall be
constrained to frame Rule against the Respondents and proceed against
them in terms of the Contempt of Courts Act.
Today, neither the Secretary, Information Department is
present nor the appointment Order of the Petitioner has been produced,
therefore, this Court is left with no other option except to frame Rule
against all the Respondents, including the Secretary, Information
Department, for not having complied with the Order of the Court.
In view of above, the learned Registrar Judicial is directed to
frame Rule/ Robkar against all the Respondents and seek their reply as also
their personal appearance before this Court on the next date of hearing.
List again on 1st of January, 2025.
Meanwhile, as a matter of abundant caution, the Secretary,
Information Department, Government of Jammu & Kashmir is directed to
forthwith issue appointment Order of the Petitioner and produce the same
before this Court on the next date of hearing.
