Mr. Debjyoti Saha, learned Advocate, is appearing for the plaintiff.

2. Ms. Akansha Mukherjee, learned Advocate, is appearing for the

defendant.

3. Counsel for the plaintiff submits that the defendant has not carried

out the amendment in the written statement and has not taken any

steps after the suit is transferred from the non-commercial division to

this Court.

4. Counsel for the defendant submits that the defendant is ready with

the affidavit of competency, affidavit under Order 11 Rule 10 of the

CPC and statement of Truth.

5. Counsel for the defendant further submits that if the Court grants

leave, the defendant will file the same by tomorrow and also prays for

leave to make necessary corrections in the cause title of the written

statement by incorporating the word “Commercial Division”.

6. Considering the submission made by the counsel for the parties, the

defendant is granted leave to file the above mentioned documents in

compliance with the provisions of the Commercial Courts Act within a

week from date and also to carry out the necessary amendment in the

written statement within a week from date.

7. The defendant is directed to serve the copy of the affidavits as well as

amended copy of the written statement to the plaintiff within a week

from date.

8. As the defendant has already filed the written statement, the parties

are directed to complete discovery and inspection of documents within

four weeks. Affidavit of admission and denial of documents be filed

within two weeks thereafter. The parties are also directed to exchange

their suggested issues in the meantime.

9. List the matter on 24th June, 2025 for framing of issues.
