The Police Inspector of H.S.R. Layout Traffic Police
Station has filed charge sheet against the accused No.1
and 2 for the offence punishable U/Sec.279, 338, 304(A)
of IPC, Sec.3(1) R/w Sec.181 and Sec.5 R/w Sec.180 of
IMV Act.
2. The brief facts of the prosecution case are as
under: –
That on 26.10.2023 at 5.15 p.m. accused No.1
being the driver of motor cycle bearing No.KA-53-HL-
6383 rode the same within the jurisdiction of HSR Layout
traffic police station on outer ring road from Silk Board
junction towards Ibbaluru at a high speed and rash and
CC No.548/2024
negligent manner so as to endanger human life and near
Agara lake, opposite to Press zone building hit to
Kum.Lakshmi aged about 9 years, Kum.Bhumika Aged
about 4 years, Kum.Maithri aged about 8 years and
C.W.4 while they crossing road from Agara lake towards
Agara village. As a result Kum.Lakshmi sustained
grievous injuries on her head and succumbed to death
and C.W.4, Kum.Bhoomika, Kum.Maithri sustained
grievous injuries. Accused No.2 being the owner of the
said vehicle he has given his vehicle to the accused No.1,
who was not having driving license at the time of
accident. As such the accused No.1 and 2 have
committed an offence punishable U/Sec.279, 338, 304(A)
of IPC, Sec.3(1) R/w Sec.181 and Sec.5 R/w Sec.180 of
IMV Act.
