The appellants have been arraigned for the offences
punishable under Sections 302, 34, 323, 337, 427, 504, 506(2), 143,
147, 148 and 149 of the Indian Penal Code, 1860 and Section 135 of
the Gujarat Police Act, 1951.
Taking into consideration the fact that the co-accused
has already been granted bail and considering the period of
incarceration, coupled further with the fact that the investigation
is over and that the trial has not commenced yet, we are inclined
to set aside the impugned order and grant bail to the appellants.
