Learned senior counsel for respondent Nos. 1 & 2,
Mr. Y. Nirmolchand; and learned senior counsel for respondent No. 3, Mr.
T. Rajendra are present before the Court physically in the proceeding of
CONT. CAS (C) No. 114 of 2022. Learned Government Advocate for the
State, Mr. Athouba Khaidem and learned counsel for the other
respondents, Mr. M. Gunedhor in the connected matters are also present
before the Court physically.
The proceeding in Contempt Case No. 114 of 2022 has been
referred by the Civil Judge (Senior Division), Imphal East, in Judl. Misc.
Case No. 121 of 2017 and the same has been revealed in the office noting.
This proceeding is connected with the proceedings in Cril. Petn. No. 2 of
2020, CRP No. 2 of 2018 and W.P. (Crl.) No. 4 of 2017.
Whereas, both the learned senior counsel, Mr. T. Rajendra
and Mr. Y. Nirmolchand fairly submit the issues involved in these matters

are in between the sisters and that these matters may be referred to the
Mediation Centre at High Court of Manipur to explore the possibility of
amicable settlement in between the parties. This submission which is made
by the learned senior counsel for the parties is taken on record.
However, keeping in view the status in these matters as well
as keeping in view Rule 9 of the Contempt of Courts (High Court of
Manipur) Rules, 2019, C-CIVIL CONTEMPT, which indicates that in a case
of a Civil contempt other than the contempt referred to in Section 14, the
High Court may take action –
(a) on its own motion; or
(b) on a petition presented by the parties aggrieved; or
(c) in the case of any civil contempt of a subordinate court
on a reference made to it by that Court.
In the meanwhile referring this Rule, the learned senior
counsel, Mr. T. Rajendra has referred to Section 10 of the Contempt of
Courts Act, 1971 relating to power vested with the High Court for
punishment. However, the issues is in between sisters and even case has
been referred by the Presiding Officer having the jurisdiction.
In a given peculiar facts and circumstances of these matters
are concerned and also keeping in view the provision of Order 10 of CPC
inclusive of Section 89 of CPC, it is deemed appropriate that these matters
be referred to the Mediation Centre at High Court of Manipur and be
scheduled on 19.08.2025.

All the parties are directed to be present physically before
the Mediator on 19.08.2025 at 01:00 pm.
Registry is directed to furnish relevant material for the
purpose of reference.
A copy of this order be furnished to all the learned counsel
appearing for the parties through their WhatsApp/e-mail for doing the
needful.
