. He has stated in his evidence that the contents of
examination-in-chief filed by him on affidavit are true and
correct. This witness, in his examination-in-chief, stated that he
knew the testatrix-late Raj Kumari Sinha, but he could not say
the name of husband of the testatrix. He further stated that the
testatrix used to visit his shoe shop and in due course she told
her desire to him for execution of the Will of her flat in the
name of her grandson, Vishal Kumar Singh. He further stated
that in the year 2012, he was called by the testatrix at her flat
situated in Gomati Apartment in Frazer Road and when he
reached at the said flat of Raj Kumari Sinha, Advocate Surendra
Kumar and a typist, Mr. Mumtaz Ahmad were also present
there. At the same time, the Will was prepared and on the
instruction of testatrix, this witness put his signature on 2nd and
4th pages of the Will. He further stated that apart from him, two
other witnesses were also present there namely, Dr. Pramod
Patna High Court TEST CASE No.3 of 2019 dt.04-07-2025
Prasad Singh and Ashok Kumar, and they also put their
respective signatures on 3rd and 4th pages of the Will as attesting
witnesses. This witness further categorically stated that while
executing the Will, the testatrix-Raj Kumari Sinha was in good
mental and physical condition. He further stated that the
testatrix first put her signatures on all the pages of the Will and
thereafter on her request, other witnesses put their respective
signatures over the Will. On showing the Will dated 04.04.2012
executed by the testatrix-Raj Kumari Sinha, this witness
identified the Will and on his identification, the entire Will has
been marked as Exhibit-1. He further identified the signatures of
the testatrix on each pages of the Will, which have been marked
as Exhibit-2, 2/1, 2/2 and 2/3, respectively. He also identified
his signatures over the Will, which have been marked as
Exhibits-3 and 3/1, respectively.
