Heard learned counsel for the petitioners and learned

Additional Public Prosecutor for the State.

2. This application for grant of anticipatory bail arises

out of Bakhtiyarpur P.S. Case No. 302 of 2024, dated

01.06.2024 disclosing offences under Sections 147, 148, 149,

341, 323, 307, 379 and 504 of the I.P.C.

3. As per prosecution story, on 24.05.2024, at about

09:00 PM, the petitioners along with one other named accused

person and 10 unknown accused persons surrounded the

informant’s brother and assaulted him by means of iron rod due

to which he sustained injury. It is further alleged that accused

persons snatched Rs. 5,000/-, one mobile and cycle.

4. Learned counsel for the petitioners submits that

petitioners are innocent and they have falsely been implicated in

the present case. He further submits that both the parties come

from the same family and there is land dispute between them

which is clear from the First Information Report itself. It is

further submitted that two FIRs have been lodged, one by the

cousin brother and another bearing Bakhtiyarpur P.S. Case No.

301 of 2024 was lodged by the uncle of the petitioners. This

Court has called for injury report of the informant from which it

appears that informant sustained lacerated wound on the head

(parietal region) and abrasion on the right hand and opinion has

been reserved regarding nature of injury.

5. The learned Additional Public Prosecutor has

vehemently opposed the prayer for bail of the petitioners.

6. Regards being had to the submissions advanced on

behalf of the parties concerned and taking into consideration the

fact that both the parties are relatives having land dispute, let the

petitioners, above named, in the event of arrest or surrender

before the court below within four weeks from today, be

released on bail on furnishing bail bonds of Rs. 10,000/- (Ten

Thousand) each with two sureties of the like amount each to the

satisfaction of the learned A.C.J.M.-III, Barh, Patna in

connection with Bakhtiyarpur P.S. Case No. 302 of 2024,

subject to the conditions as laid down under Section 438(2) of

the Code of Criminal Procedure/ Section 482 (2) of the BNSS,

2023.
