Heard Shri N. Uddin, learned Counsel for the applicant, who has filed this
application under Section 389 of the Code of Criminal Procedure, 1973 corresponding
to Section 430 of the BNSS, Act, 2023 for suspension of sentence and release the
applicant on bail during the pendency of appeal against the judgment and order dated
28.11.2024 passed by the learned Addl. Sessions Judge, Bijni in Sessions Case No.
184(B)/2018, convicting the accused/appellant under Sections 120(B)/302/392 of IPC
and sentencing him to undergo RI for life and also to pay fine of Rs.50,000/- under
Section 302 IPC, RI for 7 years and also to pay fine Rs.20,000/- under section 120(B)
and RI for 10 years and also to pay fine Rs.50,000/- under Section 392 of IPC.

The connected appeal, namely, Crl. A/15/2025 has been admitted today.
Issue notice, returnable by 6 (six) weeks.

Ms. S. Jahan, learned Addl. PP, Assam accepts notice on behalf of State
respondent.

Objection, if any, may be filed in the meantime.
