2. Heard the learned counsel appearing for the

appellants.

3. Despite service of notice, none appears for

respondent no.2/complainant.

4. A limited notice was issued only with respect to

the quantum of sentence vide order dated 05.11.2024.

5. By concurrent judgments, the appellants have been

convicted for the offences punishable under Sections 324

and 325 read with Section 34 of the Indian Penal Code,

1860 (for short, ‘the IPC’). Incidentally, the High Court

has rendered an acquittal for the offence punishable

under Section 326 of the IPC. The occurrence is stated to

have taken place way back in the year 2007.

Reason:
case, we are inclined to modify the sentence of the

appellants. Accordingly, the sentence of the appellants

stands modified to the effect that the appellants shall

appear before the Trial Court on 06.08.2025 and,

thereafter, they shall undergo the sentence till the

rising of the Court.

7. Accordingly, the appeal is allowed in part. We make

it clear that if the appellants do not appear before the

Trial Court on the fixed day, the impugned order shall

stand revived.

8. Pending application(s), if any, shall stand

disposed of.
