Order:
The Criminal petition, under sections 480 & 483 of
Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed by the
Petitioner/A1, seeking regular bail, in crime No.10 of 2025 of G.
Madugula police station, ASR District.
2. A case has been registered against the petitioner and another
for the offences punishable under Sections 20(b)(ii)(C), 25 r/w 8(c) of
the Narcotic Drugs and Psychotropic Substances Act, 1985 (for short
`the NDPS Act‘).
3. Case of the prosecution, in brief, is that, on o4.04.2025 at
about 16.30 hours at urumu Junction, G. Madugula Mandal, the
Accused No.2 was arrested while he was in possession of 40 Kgs of
Ganja worth of Rsl2,00,000/- in the presence of mediators report by
G. Ma`dugula Police. Basing on the confession of Accused No.2, the
Accused No.1 was arrested and remanded to judicial custody on
19.04-2025.
4. Learned counsel for the petitioner submits that the petitioner
was shown as Accused No.1 basing on the confessional statement of
co-accused. The petitioner was remanded to judicial custody on
19.04.2025 and since then he is languishing in J®aiI.

5. Learned Assistant Public Prosecutor submits that major portion
of the investigation has been completed.
6. Heard. Perused the record.
7. Basing on the confessional statement of Accused No.2, a case
has been registered against the petitioner herein and the petitioner
herein was not apprehended at the scene of offence. The petitioner
was arrested and sent to judicial remand on 19.04.2025 and since
then he is in jail. Hence, this Court is inclined to release the petitioner
on bail.
8. Accordingly, the Criminal Petition is allowed. The
petitioner/Accused No.1 shall be released on bail ,on executing a
personal bond for RS.10,000/-(Rupees Ten Thousand only) with two
sureties for the like sum to the satisfaction of the learned I Additional
District & Sessions Judge-Gum-Special Judge for trial of offences
under the NDPS Act, Vis-akhapatnam. The petitioner shall appear
before the Station House Officer concerned on every Sunday between
10.00 AM and 1.00 PM till filing of the charge sheet. I)
