The instant criminal petition under Section 482 of the Code of

Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of BNSS,

has been filed by the Petitioner/Accused, seeking quashment of the order

dated 07.01.2022 passed by the learned Additional Junior Civil Judge,

Chirala, Prakasam District in C.C.No.493 of 2013 issuing NBW against the

petitioner/Accused.

2. Heard Sri Dr.Challa Srinivasa Reddy, learned counsel for the petitioner

and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing

on behalf of the State.

3. Learned counsel for the petitioner would submit that the petitioner

herein filed Crl.P.No.1820 of 2016 seeking quashment of the case pending

against the petitioner/accused in C.C.No.493 of 2013. The petitioner/accused

also obtained stay in that matter vide Orders dated 15.02.2017. Learned

counsel for the petitioner would further submit that though the stay was in

force, learned Magistrate issued Non-Bailable Warrant on 07.01.2022 and

moving further to secure the presence of the petitioner before the Court.

Learned counsel for the petitioner would further submit that Crl.P.No.1820 of

2016 was dismissed for non-prosecution. As the Non-Bailable Warrant was

issued when the stay is in force, appropriate orders may be passed directing

the learned Magistrate to consider the case of the petitioner.
