1. Heard learned counsel for the petitioner and learned
counsel for the State.

2. The present bail application has been filed on behalf of
petitioner who is in custody in connection with Herhanj P.S.
Case No. 05 of 2025 registered for the offences under Sections
17
, 18 and 29 of the N.D.P.S. Act, which is pending in the Court
of learned Sessions Judge-cum-Special Judge, N.D.P.S.,
Latehar.

3. As per F.I.R., the police officials arrived at the Mari Tola,
Pandram and had destructed the poppy cultivation.

4. Learned counsel for the petitioner has submitted that the
petitioner has been falsely implicated in this case and his name
has been given by the villagers without any basis and land in
question does not belong to the petitioner over which the opium
was destroyed by the police party. It is further submitted that
two co-accused persons, namely, Akhlesh Ganjhu has been
granted bail vide order dated 15.04.2025 passed in B.A.
No.2919 of 2025 by Coordinate Bench (Hon’ble Mr. Justice

Anil Kumar Choudhary) of this Court and Baleshwar Yadav has
been granted bail vide order dated 09.04.2025 passed in B.A.
No.2817 of 2025 by Coordinate Bench (Hon’ble Mr. Justice
Ambuj Nath) of this Court. It is further submitted that the
petitioner is in custody since 27.03.2025. Hence, the petitioner
may be enlarged on bail.

5. On the other hand, learned Additional Public Prosecutor
has opposed the aforesaid prayer and has submitted that
petitioner is named in the F.I.R. and has grown poppy on forest
land and hence, prayer for bail of the petitioner may be rejected.

6. It appears that police had instituted case against seven
accused persons including this petitioner on 22.01.2025, On the
basis of disclosure made by one unknown person of the village.
It also appears that police have not named such person who has
disclosed the name of the petitioner for cultivating poppy.

7. It appears that co-accused persons, namely, Akhlesh
Ganjhu has been granted bail vide order dated 15.04.2025
passed in B.A. No.2919 of 2025 by Coordinate Bench (Hon’ble
Mr. Justice Anil Kumar Choudhary) of this Court and
Baleshwar Yadav has been granted bail vide order dated
09.04.2025 passed in B.A. No.2817 of 2025 by Coordinate
Bench (Hon’ble Mr. Justice Ambuj Nath) of this Court.

8. Considering the facts and in the circumstances of the case,
the petitioner, namely, Jitram Ganjhu is directed to be released
on bail, on furnishing bail bond of Rs.20,000/- (Twenty
thousand only) with two sureties of the like amount each to the
satisfaction of learned Sessions Judge-cum-Special Judge,
N.D.P.S., Latehar or his successor Court in connection with
Herhanj P.S. Case No. 05 of 2025 subject to the condition that

one of the bailers must be own relative of the petitioner and the
petitioner will submit self attested copy of his Aadhar Card and
also give his mobile number before the learned court below
which he will not change during pendency of this case without
prior permission of the court.

9. However, petitioner is directed to file an Undertaking
before the Court below that he will not indulge in such type of
offences again, failing which, the prosecution will be at liberty
to take steps for cancellation of bail.

10. Let a copy of this order be also sent to Superintendent of
Police, Latehar by the Office.
