Heard the parties.
2. The petitioner has been made accused in connection with S.T.
Case No. 296/2019 arising out of Khunti P.S. Case No. 99/2018
corresponding to G.R. Case No. 241/2018, for the offences registered
under Sections 109, 114, 124A, 147, 148, 149, 153(A), 153(B), 186,
290, 295(A), 302, 307, 341, 342, 323, 324, 325, 353 & 120B of the
I.P.C. and Section 27 of the Arms Act, pending in the Court of learned
Dist. & Addl. Sessions Judge-II, Khunti.
3. On 27.06.2018, Khunti police, on receiving confidential
information that two to three thousand persons have assembled at
village Ghaghra and were involved in Pathargaddi, went to the place of
occurrence. On seeing police party, the mob started assaulting them,
due to which one of the police personnel died.
4. It was submitted that though the petitioner is named in the F.I.R.
but there is no specific allegation against the petitioner. It was further
submitted that the petitioner is in custody for about six years. It was
finally submitted that some of the named accused persons have been
granted bail by the different co-ordinate Benches of this Court.
5. Learned A.P.P. has opposed the prayer for bail of the petitioner
and submitted that the petitioner has got criminal antecedent.
6. Considering the period of custody and the fact that co-accused
persons have been granted bail by different co-ordinate Benches of this
Court, I am inclined to release the petitioner, on bail. Accordingly, the
petitioner, named above, is directed to be released on bail on furnishing
bail bond of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties
of the like amount each, to the satisfaction of learned Dist. & Addl.
Sessions Judge-II, Khunti in connection with S.T. Case No. 296/2019
arising out of Khunti P.S. Case No. 99/2018 corresponding to G.R.
Case No. 241/2018.
