This is a private complaint filed under section 200 of

Cr.P.C., against the accused for the offence punishable under

section 138 of the Negotiable Instruments Act.

02.The brief facts of the complaint is as under:

The complainant, accused and her husband are well

known to each other since many years. In that acquaintance,

the accused and her husband have borrowed a sum of

Rs.14,00,000/- during the first week of March-2020 from the

complainant to meet her business expenses of Nikitha

Makeup Studio and Academy of accused situated at No.581,

3rd Stage, 4th Block, Basaveshwaranagar, Bengaluru-86 and to

meet financial obligations. Further accused and her husband

have jointly promised to return the said amount within three

months. As per their request, husband of complainant lend

Rs.6,50,000/- from his personal funds and complainant has

lend Rs.7,50,000/- out of her own funds to the accused and

her husband. To discharge said liability, accused has issued a

cheque bearing No.853754 dated 20-02-2021 for

Rs.7,50,000/- drawn on Corporation Bank, Mahalaxmi Layout

branch, Bengaluru, in favour of the complainant. The

complainant presented said cheque for encashment through

her banker Punjab National Bank and Branch, Bengaluru on

20-02-2021. The cheque is returned unpaid with bank

endorsement dated:22-02-2021 showing cheque is

dishonoured for the reason “Funds Insufficient”.
