resettlement of the Petitioners expeditiously.
(b) Direct the Respondent authorities to arrange alternate residence
for petitioners till resettlement is complete.
2. Brief facts leading to the present petition are that the petitioners are all
residents of Sector 9, Ward No. 52, Bhilai Nagar, District Durg. Petitioners
No. 1 to 184 are dependents of erstwhile employees who have been
categorized as below poverty line, therefore, they have been issued ration
cards and other documents under BPL schemes. It is stated that the
petitioners are residing in 39 blocks situated at Hospital Sector 9, every
block containing 18 dwelling houses where about 700 families and their

4500 members were also residing there. It is also stated that Bhilai Steel
Plant had started a scheme in the year 2001 to allot quarters on a
lease/license to employees or their dependents and petitioners No.185 to
220 are the dependents of the employees, therefore, they were allotted
quarters under said scheme. The petitioners No.221 to 289 are all contract
workers employed as safai karmcharis in Bhilai Steel Plant Hospital (also
known as the Jawaharlal Nehru Hospital and Medical Research Centre),
each of them is having five years of works as contract workers and they
have been provided essential services to the township community.
Petitioners No. 290 to 302 are retired employees of Bhilai Steel Plant, who
have rendered their entire lives for this public sector. It is also stated that
the petitioners for the past two years being continuously representing the
estate branch of the Bhilai Steel Plant, the Municipal Corporation Bhilai and
also the Collector and District authorities to resettle/rehabilitate them under
the available schemes and Bhilai Steel Plant proposed to demolition of their
houses as the quarters in which the petitioners are residing have been
declared unfit by the estate branch of Bhilai Steel Plant without following
provisions of Sections 309-310 of the Chhattisgarh Municipal Corporation
Act 1956.
3. It is also stated that neither any notices were issued to the petitioners for
vacating quarters which are allegedly not suitable for human being nor they
were given an opportunity to raise their grievances before the authority.
Subsequently, on 12.05.2016 Bhilai Steel Plaint issued notices to the
residents of two blocks to evict the premises within three days. Thereafter
on 25.5.2016 the Police Station Bhilai Nagar issued notices to the aforesaid

petitioners of Block 5 and 7 stating that BSP management had requested
for assistance of Police in carrying out the eviction process.
4. The petitioners had requested the Commissioner and the Mayor of the
Municipal Corporation Bhilai for their resettlement and thereafter survey of
all the blocks was carried out by them and survey list was prepared. It is
also stated that Municipal Corporation Bhilai already informed the Collector
Durg and only 18 slum residential colonies were identified for resettlement
under the slum resettlement schemes. The petitioners’ applications are
pending under the said scheme and in the survey they have been found
eligible as their names appear in the survey list with survey number. It is
also stated that the land was available for resettlement with Bhilai Steel
Plant but the Management has not shown their inclination in allotting the
lands for resettlement of those whom it was proposed to evict the quarters.
It is also case of the petitioners that on 02.06.2016 the respondents started
removing the residents of the petitioners including women and children who
were peacefully protesting against the eviction, but the respondent did not
pay any head and started demolishing the quarters which necessitated the
petitioners to file the present writ petition.
5. Learned counsel for the petitioners would submit that the petitioners are low
paid employees and they have been categorized under below poverty line,
therefore, as such sympathetically view should be taken by the Court
granting them some protection. She would further submit that respondent
No. 5 has conducted a survey to determine eligibility of the petitioners for
providing houses under Pradhanmantri Awas Yojna and for that the
petitioners have submitted form for allotment of house with Bhilai Municipal

Corporation as they are landless persons but the respondent did not
consider their applications and sent notice for removal of their houses
which is clear violation of government policy as well as fundamental rights
as provided by the constitution of India. She would further submit that the
Management has shown much eagerness in demolishing of building and
inclined to allot available lands for resettlement of those whom it was
proposed to evict the building. To substantiate her submission, she would
refer to the judgments of Hon’ble Supreme Court in the cases of Prem
Shankar Shukla vs Delhi Admn. (1980) 3 SCC 526, Mockinnon
Mockernzie and Co. Ltd. V Andrey D’ Cosa reported in 1987 (2) SCC
469, Sheela Barse vs Secy. Children‘s Aid Society reported 1987 (3)
SCC 50, Vishaka v. state of Rajasthan reported 1997 (6) SCC 241,
People’s Union for Civil Libertis v. Union of India reproted 1997 (3)
SCC 433, D.K. Bau vs. State of W.B. reported 1997 91) SCC 416,
apparel Export promotion Council vs A.K. Chopra reported 1999 (1)
SCC 759.
6. Respondent No. 1, 5 and 7 filed their return on 09.11.2016 wherein they
stated that the houses in which the petitioners were residing are the
property of Bhilai Steel Plant and are under control of it and Bhilai Steel
Plant has permitted some of the petitioners being its employees or the
dependents of its earlier employees, to reside in the said house and no
relief has been sought against them and would pray for dismissal of the writ
petition.
7. Respondent No. 6 has filed its return on 08.04.2017 wherein they stated
that the houses in which the petitioners are residing is unfit for living since

they were residing in it for the last 50 years and the petitioners have
managed the local body and have prepared ration cards and other
documents under BPL though they are not entitled. It is also contended that
as per agreement between Special Area Development Authority and Bhilai
Steel Plant the building situated at Hospital Sector-9 is to be managed and
controlled by Bhilai, as such Bhilai Steel Plant has to rehabilitate the
persons residing in the Hospital Sector-9. It has also been contended that
looking to the interest of ward resident, Ward Member has written letter to
Municipal Corporation for survey and the Municipal Corporation has already
done survey in the said ward which does not give right for rehabilitation of
the petitioners as they were residing in the area under control of Bhilai Steel
Plant and would pray for dismissal of the writ petition.
8. On the other hand, learned counsel for Respondent No. 3 and 4 would
submit that condition of building is very deteriorating and the petitioners are
unauthorized occupants of the building and only some of the petitioners
have granted license for 11 months only long back which has already been
come to an end. The petitioners despite aware of the fact that condition of
the building is pitiable and on account of Rainy Season there is chance of
misshaping, therefore, demolition of the building is necessary. It is also
contended that Bhilai Steel Plant is responsible for management and
administration of properties including allotment. The petitioners are
unauthorized occupants of the quarters, therefore, they are liable to be
evicted from the premises in view of provisions of Public Premises (Eviction
of Unauthorised occupants) Act 1971 (in short Act of 1971). It is
empathically denied that the petitioners are paying water tax, electricity bill

etc according the conditions of the license right upto the year 2014-15. It
has also been contended that most of the quarters declared as unfit for
inhabitation were unauthorizedly occupied by unknown persons. The
unauthorized occupants of these quarters misused electricity, water and
other services and no money is being paid by them till today. It has also
been contended that respondent company is suffering a minimum loss of
Rs. 15,12,433.00 per month and has suffered a loss of Rs. 10,88,95,176 till
June 2022 i.e. during period of 72 months. It has also been contended that
the quarters where the petitioners are residing unauthorizedly are not safe
for human being, therefore, after following due process Public Premises
(Eviction of Unauthorized Occupants)Act 1971 the residents were evicted,
thereafter notice were given to them for eviction Block No. 5 and 7 on
02.06.2016 and would pray for dismissal of the writ petition.
9. On 18.07.2016, this Court has granted interim relief to the petitioners
restraining the respondents to demolish and eviction of the petitioners till
the next date of petitioners.
10. I have heard learned counsel for the parties and perused the record.
11. Considering the submission, it is quite vivid, that the petitioners have not
filed any document to establish that they have been authorized by the Bhilai
Steel Plant to live in the premises. This Court cannot lose sight of the fact
that some of the petitioners fathers and mothers were employed in the
hospital run by the Bhilai Steel Plant but after their superannuation or
unfortunate death, the petitioners are not entitled to continue in the
premises allotted to their fathers and mothers. It is well settled position that
residential facilities which provide to an employee till they remain in service

and it co-terminous on account of superannuation of the employee or after
their death and it cannot be claimed by the dependents of the employee as
right of inheritance, prima-facie establish that the petitioners are occupying
the premises unauthorizedly.
12. Be that as it may, determination of issue whether the petitioners are
encroachers or illegal occupants of the premises required evidence and
material facts which can be adjudicated by the mechanism provided under
Public Premises (Eviction Of Unauthorized Occupants) Act, 1971, therefore,
this writ petition is liable to be disposed of directing the parties to take
recourse available to them before the Estate Officer appointed under Act of
1971.
13. The issue with regard to illegal demolition of the house and steps to be
taken by the authorities are subject matter of adjudication before the
Hon’ble Supreme Court in reference case Writ Petition (Civil) No. 295 of
2022; Direction in the matter of demolition of structures reported in
2024 SCC OnLine SC 3291 wherein the Hon’ble Supreme Court has
issued following directions which is as under:-
90. In order to allay the fears in the minds of the citizens with
regard to arbitrary exercise of power by the officers/officials of the
State, we find it necessary to issue certain directions in exercise of
our power under Article 142 of the Constitution. We are also of the
view that even after orders of demolition are passed, the affected
party needs to be given some time so as to challenge the order of
demolition before an appropriate forum. We are further of the view
that even in cases of persons who do not wish to contest the
demolition order, sufficient time needs to be given to them to
vacate and arrange their affairs. It is not a happy sight to see
36women, children and aged persons dragged to the streets
overnight. Heavens would not fall on the authorities if they hold
their hands for some period.
91. At the outset, we clarify that these directions will not be
applicable if there is an unauthorized structure in any public place
such as road, street, footpath, abutting railway line or any river
body or water bodies and also to cases where there is an order for
demolition made by a Court of law.
(A) Notice
(I) No demolition should be carried out without a prior show cause
notice returnable either in accordance with the time provided by
the local municipal laws or within 15 days’ time from the date of
service of such notice, whichever is later.
(II) The notice shall be served upon the owner/occupier by a
registered post A.D. Additionally, the notice shall also be affixed
conspicuously on the outer portion of the structure in question.
(III) The time of 15 days, stated herein above, shall start from the
date of receipt of the said notice.
(IV) To prevent any allegation of backdating, we direct that as soon
as the show cause notice is duly served, intimation thereof shall be
sent to the office of Collector/District Magistrate of the district
digitally by email and an auto generated reply acknowledging
receipt of the mail should also be issued from the office of the
Collector/District Magistrate. The Collector/DM shall designate a
nodal officer and also assign an email address and communicate
the same to all the municipal and other authorities in charge of
building regulations and demolition within one month from today.
(V) The notice shall contain the details regarding:
a. the nature of the unauthorized construction
b. the details of the specific violation and the grounds of
demolition.
c. a list of documents that the noticee is required to furnish along
with his reply.

d. The notice should also specify the date on which the personal
hearing is fixed and the designated authority before whom the
hearing will take place;
(VI) Every municipal/local authority shall assign a designated
digital portal, within 3 months from today wherein details regarding
service/pasting of the notice, the reply, the show cause notice and
the order passed thereon would be available
(B) PERSONAL HEARING
i. The designated authority shall give an opportunity of personal
hearing to the person concerned.
ii. The minutes of such a hearing shall also be recorded.
(C) FINAL ORDER
i. Upon hearing, the designated authority shall pass a final order.
ii. The final order shall contain:
a. the contentions of the noticee, and if the designated authority
disagrees with the same, the reasons thereof;
b. as to whether the unauthorized construction is compoundable, if
it is not so, the reasons therefor;
c. if the designated authority finds that only part of the construction
is unauthorized/non compoundable, then the details thereof.
d. as to why the extreme step of demolition is the only option
available and other options like compounding and demolishing
only part of the property are not available.
14. Considering this aspect of the matter, the interim order passed by this
Court is vacated and the respondents No. 3 and 4 are at liberty to proceed
in the matter in accordance with Public Premises (Eviction of Unauthorized
Occupants) Act, 1971. The Estate Officer appointed under the Act, shall
decide the matter within outer limit of nine months from the date of first
appearance of the petitioners in accordance with law. It is also directed that
the petitioners will not adopt any delay tactics and they shall cooperate in
the proceedings and will also not make any attempt to avoid service of the

notice which will be issued to them by the Estate Officer. It is also directed
that the Estate Officer may serve the notices by any mode permissible
under the law including service of humdast also. It is made clear that this
Court has not made any observation on the contentions of the parties and
the same will be decided by the authorities appointed under the law.
Accordingly, the writ petition is disposed of.
15. Interim order granted by this Court on 18.07.2016 shall stand vacated.
