The Private Complaint is filed by the Complainant under

Section 200 of Cr.P.C. against the accused alleging that she has

committed the offence punishable under Section 138 of Negotiable

Instruments Act.

2. The brief facts of the complaint are as follows:

The complainant submits that the Accused is well known to

him as both he and Accused were residing in very same locality and

the Accused is residing in opposite house which was situated at

Mulubagal. The Accused is doing private chit business in and

around Mulubagal and the Accused has incurred huge loss in the

said chit business as such she approached him for a handloan of

Rs.2 lakhs to clear her legal and family necessities and also to clear

the chit transactions. As such he considering her request, has paid

Rs.2 lakhs by way of NEFT on 19.7.2019 and the Accused has

received and acknowledged the same and agreed to repay the same

as early as possible.
