This case has arisen from a complainant filing

a complaint against the accused No.1 to 3 under

Section 138 of the Negotiable Instruments Act.

2. The relevant facts required to adjudicate

this case are as follows:

The accused No.1 is a partnership firm and

the accused No.2 and 3 are its partners. The

accused No.1 is into the business of exporting

granites having branches in Mahalakshmipuram

approached the complainant and requested for a

C.C.No.35767/2021

hand loan of Rs.20 lakhs for the purpose of their

business in the year 2015. The accused No.2 and 3

voluntarily agreed to pay monthly interest of

Rs.70,000/-. As the accused No.2 and 3 were family

friends, the complainant agreed to advance the

loan.
