1. This bail application under Section 483 BNSS (439 Cr.P.C.) is

laid by petitioner in connection with an FIR No.297/2017,

registered at Police Station Garhi, District Banswara wherein he is

charged for offences punishable under Sections 379 of IPC.

2. Heard learned counsel for the petitioner and learned Public

Prosecutor. Perused the material available on record.

3. Learned counsel for the petitioner stated that petitioner

could not appear before learned trial Court on 17.10.2022 due to

some unavoidable reasons, therefore, his bail bonds were forfeited

and arrest warrant has been issued against him by the learned

trial Court. It is further submitted that the petitioner now assures

that he will appear before the trial Court on every date of the

hearing. Lastly, it is submitted that trial will take time, therefore,

benefit of bail may be granted to the petitioner.

5. Per contra learned Public Prosecutor has opposed the bail

application of the accused-petitioner.

6. This is a matter of bail jump.

7. Having regard to the facts and circumstances of the case,

without expressing any opinion on the merits/demerits of the

case, this Court is of the opinion that the bail application filed by

the petitioner deserves to be accepted.

8. Accordingly, the bail application under Section 483 BNSS

(439 Cr.P.C.) is allowed and it is ordered that accused-petitioner

Kamlesh S/o Manilal Patel arrested in connection with F.I.R.

No.297/2017, Police Station Garhi, District Banswara, may be

released on bail; provided he furnishes a personal bond of

Rs.50,000/- with two surety bonds of Rs.25,000/- each to the

satisfaction of learned trial Court with the stipulation to appear

before that Court on all dates of hearing and as and when called

upon to do so till the completion of the trial.
