3. Second Bail Application bearing BAIL APPLN. 2532/2025 under
Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter
referred to as ‘B.N.S.S.’) Petitioner, Karan Manchanda and the First Bail
Application bearing BAIL APPLN. 2624/2025 under Section 483 of
B.N.S.S. (old Section 439 of Cr.PC) have been filed on behalf of the
Petitioner, Anurag Yadav @ Vishal Rao respectively for grant of Regular
Bail in FIR No. 349/2024 dated 11.05.2024 under Section 323/302/34 of the
Indian Penal Code, 1860 (hereinafter referred to as ‘IPC‘) registered at
Police Station Bharat Nagar.
4. It is submitted that the Application filed before the Ld. Sessions
Court, has been dismissed vide Order dated 05.07.2025 The Charges have
already been framed and the material prosecution witnesses have already
been recorded, who have not supported the case of the Prosecution.
5. Petitioner, Karan Manchanda is 26 years old and had surrendered
before the police authorities at Police Station Bharat Nagar on the same day.
He has been falsely implicated in this case. He has clean antecedents. It is
further submitted that that he is in judicial custody for more than one year
and three months. The Applicant has been granted Interim Bail four times
during the trial and he has abided by the terms so imposed upon him. He
always surrendered on time. While the Bail Application of the Petitioners
has been dismissed, but on the same ground the Bail has been granted to
Vishwas Raj @ Vimcy vide Order dated 03.06.2025.
6. Reliance has placed on P. Chidambaram vs. Directorate of
Enforcement, (2020) 13 SSC 791 and K. Rajapandian vs. State of NCT of
Delhi, to submit that ‘the object of bail is to secure the attendance of the
Accused.’ Reliance has also been placed on Yudhveer Singh Yadav vs.

Central Bureau of Investigation through Secretary, Government of India,
Bail Application No. 3563/2023 (Delhi High Court).
7. Petitioner, Anurag Yadav @ Vishal Rao is in judicial custody since
14.05.2024. It is submitted that in the Application filed before the Ld.
Sessions Court, has been dismissed vide Orders dated 01.07.2025. The
Charges have already been framed and all the public witnesses have already
been examined, who have not supported the case of the Prosecution. The
Petitioner has deep roots in the society, has a permanent place of residence
and there is no likelihood of him absconding or tampering with prosecution
evidence.
8. Hence, a prayer for grant of Regular Bail is sought.
9. Status Report has been filed on behalf of the State wherein it is
submitted that on the basis of information received vide DD No. 45A
regarding a dead person being brought to Deep Chand Bandhu Hospital.
Investigations were commenced and the FIR No. 349/2024 was registered.
During the investigations, the name of two Applicants along with Vishwas
Raj @ Vimcy, emerged as the accused persons. They were arrested and
Charge-Sheet filed. Eight witnesses have already been recorded, out of 32
prosecution witnesses. There was no previous involvement of the two
Petitioners.
10. Submissions heard and the record perused.
11. The case of the Prosecution rested on the statements of two eye
witnesses, but they have not supported the case of the Prosecution. The other
six witnesses examined by the Prosecution, have also not supported the
Prosecution. The Applicants, Karan Manchanda and and Anurag Yadav @
Vishal Rao are in judicial custody for more than one year and three months.

Considering the totality of circumstances, both the Applicants, Karan
Manchanda and Anurag Yadav @ Vishal Rao are granted Regular Bail, on
the following terms and conditions:
a) The Petitioners/Accused shall furnish a personal bond of
Rs.35,000/- each and one surety of the like amount each, subject to
the satisfaction of the learned Trial Court.
b) The Petitioners/Accused shall appear before the Court as and
when the matters are taken up for hearing;
c) The Petitioners/Accused shall provide their mobile
number/changed mobile number to the IO concerned which shall be
kept in working condition at all times;
d) The Petitioners/Accused shall not indulge in any criminal
activity and shall not communicate or intimidate the witnesses.
e) In case the Petitioners/Accused change their residential
addresses, the same shall be intimated to learned Trial Court and to
the concerned I.O.
12. The copy of this Order be communicated to the concerned Jail
Superintendent, as well as, to the Ld. Trial Court.
13. The Bail Application are accordingly disposed of.
