Heard Mr. Ng. Jotindra Luwang, learned counsel appearing
for the petitioner and Mrs. L. Monomala, learned GA appearing for the
respondents.
It has been submitted by the learned GA that she is unable
to get instruction from the authorities in terms of the earlier direction
given by this court and the learned GA, accordingly, prays for granting
one week’s time to get necessary instruction. On the other hand,
Mr. Ng. Jotindra Luwang, learned counsel appearing for the petitioner
submitted that the present writ petition has been fixed today for
consideration of the prayer for passing interim order.
It has been submitted by the learned counsel appearing for
the petitioner that the petitioner was placed under suspension by an
order dated 11-11-2024 and till today, the authorities have not release
any subsistence allowance due payable to the petitioner during the
period of her suspension as provided under FR 53(1) of the FR & SR
and that because of non-payment of the subsistence allowance, the
petitioner is facing a lot of hardship. The learned counsel, accordingly,
prays for passing an interim order directing the respondents to release
the subsistence allowance due payable to the petitioner during the
period of her suspension.

As the respondents did not disputed about the non-payment
of the subsistence allowance due payable to the petitioner during the
period of her suspension as provided under FR 53(1) of the FR & SR, it
is hereby directed that the respondents should release the subsistence
allowance due payable to the petitioner as provided under FR 53(1) of
the FR & SR. The same should be released within a period of 40 (forty)
days from today.
List this case again on 24-07-2025
