1. Leave granted.
2. Heard learned counsel appearing for the
parties.
3. The offences alleged against the appellant
are under Sections 307, 324, 323, 504 and 506 of
the Indian Penal Code, 1860 (for short, ‘the
IPC’). Subsequently, by way of supplementary
charge-sheet, Section 302 of the IPC was added.
4. We may note here that the incident is of 21 st
August, 2022 and the victim died on 3rd December,
2022 after discharge was taken from the hospital
against medical advice. The appellant has
undergone incarceration for a period of about 2 ½

examined. Therefore, the appellant is entitled to
be enlarged on bail on appropriate stringent terms
and conditions.
5. For that purpose, the appellant shall be
produced before the Trial Court within a maximum
period of one week from today. The Trial Court
shall enlarge the appellant on bail pending the
trial on appropriate stringent terms and
conditions including the condition of regularly
and punctually attending the Trial Court and
cooperating with the Trial Court for early
disposal of the case. The Public Prosecutor shall
be heard before fixing the terms and conditions.
6. The Appeal is accordingly allowed.
7. Pending applications stand disposed of.
