[1] Learned senior counsel for the petitioner, Mr. N. Umakanta
is present before the court physically and wherein the said senior counsel
is pressing for consideration of the prayers which is indicated in this PIL
proceeding.
[2] While recording the submissions made by the learned senior
counsel on behalf of the petitioner in this matter and whereby the learned
AG namely, Mr. Lenin Hijam submitting that whatever reliefs whcih have
been sought for in this matter, it is in the nature of Public Interest Litigation
and the same have already been provided but the learned senior counsel
for the petitioner in this matter submitting that in this PIL seeking for
mandamus to take all the necessary steps for the welfare measure and

the same have been indicated in the prayer column No.3 of this PIL.
Therefore, keeping in view the status of this matter and more so keeping
in view the submissions made by the learned AG as well as the
submissions made by the learned senior counsel for the petitioner, this
petition has been initiated in the nature of Public Interest Litigation.
However, the learned senior counsel for the petitioner in this matter is
seeking for short accommodation to persuade the matter in accordance
with law whereas, the learned AG for the respondents is seeking for
closing of this PIL.
[3] However, in a given peculiar facts and circumstances and
more so keeping in view provision of Article 14 of the constitution of India
relating to equality before law and also keeping in view the Article 19 of
the Constitution and more so Article 21 relating to life and personal liberty,
it is deemed appropriate all these Articles are very much required to
address the issues in this PIL. Therefore, learned AG be directed to
submit a report in writing and copy of the same shall be furnish to the
petitioner. Accordingly, made an observation.
[4] In the meanwhile, the learned senior counsel for the
petitioner is also permitted to submit various welfare measures to be taken
by the State authorities in the form of an affidavit.
[5] Hence, this matter would be listed on 12.08.2025.
