This application for bail under Section 483 BNSS (Earlier
Section 439 Cr.P.C.) has been filed by the petitioner who has been
arrested in connection with F.I.R. No.70/2025, registered at Police
Station Anadra, District – Sirohi, for the offences under Sections
271, 272, 318(4) and 319(2) of BNS and Sections 15(2) and
15(3) of Indian Medical Council Act and Section 34 of National
Medical Commision Act.
Heard learned counsel for the petitioner and the learned
Public Prosecutor. Perused the material available on record.
Learned counsel for the petitioner submitted that the
allegation against the petitioner is of illegaly establishing a clinic
and giving treatment to the general public without any legal
documents. It is further submitted on behalf of the petitioner that
the Police, merely acting upon an information, registered a case
against the present petitioner. The Police apprehended the
petitioner from his shop where the petitioner was only sitting and

not attending to any patients. Learned counsel for the petitioner
submits that the petitioner is not guilty of the charges leveled
against him and he has been falsely implicated in this case.
In addition to this, learned counsel for the petitioner also
submitted that the petitioner has been behind the bars since the
date of his arrest i.e. 27.05.2025 and the trial of the case will take
sufficiently long time, therefore, he prayed that the petitioner be
enlarged on bail.
Learned Public Prosecutor on the other hand has vehemently
opposed the bail application.
Having considered the rival submissions, facts and
circumstances of the case; taking into consideration the fact that
challan of the case has been presented; without expressing any
opinion on merits/demerits of the case, this Court is inclined to
enlarge the petitioner on bail.
Consequently, the bail application under Section 483 BNSS
(Earlier Section 439 Cr.P.C.) is allowed and it is ordered that the
accused-petitioner – Krishan Pal Singh S/o Manohar Singh,
arrested in connection with F.I.R. No.70/2025, registered at Police
Station Anadra, District – Sirohi, shall be released on bail, if not
wanted in any other case, provided he furnishes a personal bond
in sum of Rs.50,000/- along with two sureties of Rs.25,000/-
each, to the satisfaction of learned trial Court, for his appearance
before that Court on each and every date of hearing and whenever
called upon to do so till completion of the trial.
