1. The petitioner seeks anticipatory bail in a pending trial
wherein the petitioner has been summoned under Section 319 of
the Code of Criminal Procedure (for short ‘the Cr.P.C.). The
order summoning the petitioner under Section 319 of the

Reason: a criminal revision. The High Court set aside the summoning
order against which the matter came to this Court. This Court
set aside the order of the High Court and restored the order

of the Trial Court. Now, the Trial Court on failure of the
petitioner to appear has issued non-bailable warrants against
the petitioner.
2. In such circumstances, we decline to accept the prayer
for anticipatory bail as made by the petitioner.
3. The special leave petition is, accordingly, dismissed.
4. However, we deem it appropriate to grant a week’s time to
the petitioner to appear before the Trial Court concerned and
apply for bail, if so advised.
5. If the petitioner fails to appear within the period
provided above, the Trial Court would be free to execute the
non-bailable warrant issued against the petitioner.
6. Pending application(s), if any, shall stand disposed of.
