Heard the parties.
2. The present application has been filed for the
following reliefs:-
(i) For directing the respondents to ensure the
proper and fair investigation of Athmalgola P.S.
Case No.393 of 2023, dated 03.12.2023 registered
allegedly for offences under Sections 147, 148,
149, 341, 307, 326 of the Indian Penal Code and
27 of the Arms Act against nine persons including
the petitioners’ three sons who are not at all

2/2involved in this occurrence and have been falsely
implicated owing to political biasedness and
further to exonerate petitioner’s three sons from
present prosecution on finding them innocent.
(ii) During pendency of this application, the
petitioner arrest of petitioner’s son, namely, Vinay
Bhushan (sitting Mukhia) and Darogin Singh
regarding Athmalgola P.S. Case No.393 of 2023
may be kept in abeyance.
3. The then Investigating Officer and the present
Investigating Officer of Athmalgola P.S. Case No.393 of 2023
have appeared before the Court.
4. From the records it appears that the directions of
the Deputy Superintendent of Police, who has supervised has
been followed by the then Investigating Officer of Athmalgola
P.S. Case No.393 of 2023. In these circumstances, there is no
merit in the present case.
5. Accordingly, this application is dismissed.
