The Private Complaint is filed by the Complainant under

Section 200 of Cr.P.C against the accused alleging that he has

committed the offence punishable under Section 138 of

Negotiable Instruments Act.

2. The brief facts of the complaint are as follows:

The complainant submits that he and Accused are known

to each other since a long time and are good friends as they

both belong to the same village and community. On account of

the said acquaintance, the Accused used to visit him and his

family. The Accused approached him for a financial assistance

during the month of May 2018 to repay his debts, which

borrowed in the year 2016 to perform his daughter’s marriage.

The Complainant obtained a gold loan from Muthoot Finance

Ltd. On 22.5.2018 and paid Rs.5.5 lakhs by way of cash as

demanded by the Accused. The Accused had promised to repay

the at the earliest.
