Pursuant to notice Mr. Arun Kumar, learned counsel has appeared on
behalf of respondent nos. 3 and 4. Notices upon respondent nos. 1 and 2 have
already been validly served and with a view to provide one more opportunity to them
the matter was adjourned on 17.04.2025. Mr. Mukul Kr. Singh, learned counsel is
present on behalf of respondent no.5-Deputy Commissioner.
2. Heard Mr. Anil Kumar Singh, learned counsel for the appellant and Mr.
Mukul Kr. Singh, learned counsel for the respondent-State and Mr. Arun Kumar,
learned counsel for the respondent nos. 3 and 4.
3. Mr. Anil Kumar Sinha, learned counsel for the appellant submits that I.A.
No. 8164 of 2024 has been filed for condoning the delay of 1892 days in filing the
present second appeal. He submits that in view of the communication gap appeal has
not been preferred within time and delay of 1892 days has occurred. He submits that
the appellant had gone out of station for his livelihood. On these grounds, he submits
