About the Company
Tata Steel operates integrated manufacturing facilities in Jamshedpur and Kalinganagar, with captive iron ore and coal mines, a dolomite mine, a chromite mine and manganese mines spread across Jharkhand, West Bengal and Odisha in India. Role Description
To handle litigation arising out of indirect taxes especially GST cases at the level of adjudicating authority and appellate authority (Commissioner (Appeal)).
To do legal analysis of t he statutory provisions, notifications and circulars pertaining to excise, service tax and customs
- Coordination with internal and external agencies:
- To coordinate and interact with the Indirect Taxes CoE for analyzing the issues involved in the show cause notices for preparation of defense reply or appeal, as the case may be. If SCN/appeal has reference to out locations then interact with F&A of such out location.
- Gather information/data required for analyzing the issue in dispute and for drafting reply to SCN or appeal, as the case may be.
- Coordinate with Advocates/law firms for managing the litigation.
- Legal analysis:
- To do extensive legal research with the help of electronic/online research tools for developing the contentions to be incorporated in the reply to the SCNs/appeal.
- Remain updated with the development in indirect tax law. Support team of Indirect Taxation, Legal (I&L) with:
- latest case laws, notifications and circulars on the subject.
- (legal research for preparing in house opinions.
- Drafting :
- Draft reply to Show cause notices and petition for appeal, as the case may be.
- Where the preparation of reply/appeal petition has to be referred to an external agency then support such external agency with well researched note prepared on the basis of legal and factual inputs collected in the aforesaid manner.
- Represent TSL before adjudicating authority and Appellate Authorities (Commissioner (Appeal) & CESTAT)
- To argue the case before adjudicating authority and appellate authority (Commissioner (Appeal), if required.
- Interaction with Law firms and Advocates:
- Take initiative in briefing the counsels.
- Support the counsel with notes on issues referred to him containing the factual and legal aspects of the matter.
Eligibility
LLB (5 years course) or LLB (3 years course)
Required Skills
- Should have actively handled GST litigations for at least 3 years.
- Should be well acquainted with hierarchy of GST, Excise and service tax authorities and have practical exposure to procedures involved in adjudication and appellate proceedings relating to GST, excise and service tax cases.
- The candidate should be well versed with statutes pertaining to GST, Central Excise and service tax and the rules issued thereunder regarding cenvat credit, valuation, filings of appeals, tariff etc.
- Knowledge of allied laws like CPC, IPC, Cr PC, Indian Evidence Act, Indian Contract Act etc.
- Should be able to effectively brief the Advocates.
- Must have good analytical and drafting skills.
- The candidate should have good inter-personal & communication skill and should be able to mentor the sub-ordinate colleagues.
- The person should be self-motivated with high desire to get the result.
- Should be computer savvy (Excel, PPT etc.)
