Perused the records.
From the office note dated 09.12.2024, it has been observed that the notice has been
issued to the respondent No. 7 by registered post with A/D as well as by through dasti mode
on 04.01.2024.
Now, in regard to the aforesaid notices issued to the respondent No. 7, the following
facts have been observed, which are as follows:-
In respect of the notice issued through registered post with A/D: – It appears that
neither the A/D card nor the un-served notice has been received by the concerned section as
of yet.
In addition to the aforesaid, it appears that the postal track consignment report
regarding the aforementioned notice is also not available at the Indian Post website.
In respect of the notice issued through dasti mode: – It appears that the petitioner has
filed an affidavit regarding service of dasti notice upon the respondent No. 7. In the said
affidavit, it has been stated that the notice has been duly received by the said respondent. As
such, it may be said that service in respect of the respondent No. 7 has been
completed.
In view of the above, the matter may be placed before the Hon’ble Court.
