The complainant has filed the complaint under Section 200

of Criminal Procedure Code against the accused for the offence

punishable under Section 138 Negotiable Instruments Act.

2. The brief case of the complainant is as under:

That the complainant is a Registered Partnership firm

carrying money lending business with money lending licence

valid upto 31.03.2028. The accused as a Joint Borrower and M.

Venkatesh as a borrower, borrowed loan of Rs.75,000/- on

18.12.2021 and Rs.50,000/- on 28.05.2022 from the

complainant for urgent needs of finance by executing On

Demand Promissory Note and Consideration Receipt with a

promise to repay the same with interest at the rate of 16% p.a.

Inspite of several request made by the complainant, both of

them failed to repay the loan amount to the complainant.
