notice dated 5th March, 2025 under Section 496A of the Kolkata Municipal
Corporation Act 1980. Challenging the said notice, the writ petitioner has filed
one application being GA/1/2025 seeking inter alia to maintain the status quo
in respect of the nature and the character of the plot of land in question and
also to restrain the respondent authorities from taking any coercive steps
against the petitioners as per the notice dated 05.03.2025 issued by the
respondent authorities.
Since the disputes encompasses a plot of land, it is allegedly being
classified by the BL & LRO as ‘Bastoo’ but the respondent authorities considers
the plot of land as a ‘water body’ forming to be the part of the list of water
bodies prepared and maintained by respondent authorities, as a result of
which there arises a controversy with regard to the nature and the character of
the plot of land in question.
