The Court: 1. Mr. Dey, learned advocate representing the

respondents on instruction submits that the petitioner for being entitled

to a provisional order of release, an appropriate application under section

110(1) of the Customs Act, 1962 ought to be filed.

2. Having regard to such submissions made by Mr. Dey and

noting from the submission of Mr. Chakraborti and the materials on

record that an application in this regard has already been filed by the

petitioner on 27th January 2025, I am of the view that such application

ought to be disposed do at the earliest. However, having regard to the

subsequent developments as noted above, I am of the view that the

petitioner should be afforded with a further opportunity to incorporate

the subsequent events by way of filing a further application before the

appropriate authority. In the event such further application before the

appropriate authority is filed within a period of 10 days from date, the

appropriate authority shall, having regard to the observation made

hereinabove, hear out such application and dispose of the same in

accordance with law within a period of two weeks from the date of filing

such application.
