                WRIT PETITION No.15281 OF 2020

O R D E R:

This Writ Petition is filed under Article 226 of the
Constitution of India, seeking the following relief/s:-

“… to issue a Writ or direction, more particularly a Writ of Mandamus for the
action of respondents more particularly that of respondent No.4 in sealing
the business premises No.1-9-1/E/3, Vasavi Nagar Colony, Medak Town and
District without any prior notice and in violation of the operational
procedure and the terms and condition of Franchise Agreement between me
and respondent No.5 is challenged in this Writ Petition as being arbitrary,
illegal and violative of Art.14, 19(1)(g), 21 and 300-A of Constitution of India
apart from Clause 14 of the APT Online Limited-Franchise Agreement and
consequently direct the respondent No.4 to remove the lock on business
premises No.1-9-1/E/3, Vasavi Nagar Colony, Medak Town and District and
pass such other suitable order or orders …”

petitioner and Mr.H.Rakesh Kumar, learned Assistant

3. The brief facts of the case are that the petitioner is a

Proprietory concern and operating the services covered by the

Franchise Agreement from 2012 without any complaint; that

apart from online and Mee seva services, the petitioner was

undertaking the works of xerox, lamination, sale of

application, stationery etc.; that the authorization of the

petitioner was valid upto 11.05.2021. Whileso, on

18.08.2020, the petitioner and his employees were necked out

of the subject premises by respondent No.4 without any

notice. Aggrieved by the same, the petitioner filed the present

Writ Petition.

4. Learned counsel for the petitioner submits that this

Court vide order dated 14.10.2020 directed respondent No.4

to open the lock of the subject premises, to enable the

petitioner to continue its business in lamination, xerox,

printing and other business not connected to Mee Seva

Services.

5. He further submits that the licence with regard to the

subject premises had expired during the year 2021 and that

the petitioner is not in the possession of the property. Now the

petitioner seeks liberty of this Court to apply for renewal of

licence with regard to the subject premises which has expired

during the year 2021.

6. Opposing the same, learned Assistant Government

Pleader for Revenue submits that as on the date the petitioner

has no locus standi to apply for renewal of licence. However,

the same would be considered in accordance with law.

7. Having regard to the submissions of both the learned

counsel, this Court is of the opinion that the cause in this

Writ Petition does not survive for adjudication any further and

hence, this Writ Petition is dismissed. However, as sought for

by the learned counsel for the petitioner, it is open to the

petitioner to file an application seeking renewal of licence

before the appropriate forum. On filing such application, the

respondent authorities are directed to consider the same and

pass appropriate orders as per law. No costs.

Miscellaneous petitions pending, if any, shall stand
closed.
