The complainant has filed the complaint under Section 200

of Criminal Procedure Code against the accused for the offence

punishable under Section 138 Negotiable Instruments Act.

2. The brief case of the complainant is as under:

That the complainant is dealing in paper, paper products,

flex materials etc. The accused is one of the customer of the

complainant and he has purchased goods on credit from

01.04.2022 to 31.3.2023 under credit invoices as per the

statement of account from Bangalore and 30.04.2022 to

31.03.2023 from Telangana, Hyderabad Branch. The accused

was in due of Rs.4,84,917.60/- towards principle plus interest

Rs.91,0000.24 totally Rs.5,75,919.00. The accused towards

payment of said due issued a cheque bearing No.185940 dated

20.10.2023 for Rs.4,84,917.76 drawn on ICICI Bank. The

complainant presented the said cheque through its banker ie

Standard Chartered Bank, Koramangala, Bangalore and said

cheque returned dishonored on 02.12.2023 for the reason

“Funds Insufficient”. Therefore the complainant got issued legal

notice dated 11.12.2023 calling upon the accused to pay the

amount covered in the cheque. The notice was duly served on

the accused on 13.12.2023. Inspite of service of notice, the

accused failed to pay the claim amount to the complainant

within the statutory time. Therefore, the accused has committed

the offence under Section 138 of Negotiable Instruments Act.
