1. This hearing has been done through hybrid mode.
2. In this batch of writ petitions, three categories have already been
created by the predecessor Bench on 01st May, 2024. The same being –
● Category 1 – Retail,
● Category 2 – Real Estate &
● Category 3 – Fast Moving Consumer Goods.
3. Let ld. Counsel who are present today before the Court mention the writ
petition number along with the category so that all the three separate
categories can be taken up for hearing in three batches. The list so prepared is
set out below as Annexure-1.
4. A submission has been made by Mr. Zoheb Hossain appearing for
Directorate General of Anti-Profiteering that since the validity of law has
already been upheld by the learned Division Bench vide judgment dated 29th
January, 2024, the petitions may be relegated to the appropriate Court i.e.,
Single Bench for consideration of each of the matters on merits, if permissible.
5. This issue has been put to ld. Counsel for the Petitioners including ld.
Senior Counsel Mr. Tarun Gulati, who clearly submits that since only a part
decision is taken by the Division Bench while upholding the constitutional
validity, the matters may continue before the Division Bench itself.
