Sri.S.K.Radhavendra, claiming to be the proprietor of
M/s.TLS Paper Products has filed this suit against the
defendant No.2 – Sri.Varavani Dhattathreya Raghavendra, the
proprietor of defendant No.1 – M/s.SRS Enterprises seeking a
money decree for Rs.5,08,408/- and costs of the present
proceedings. The plaintiffs case in a nutshell is that the
plaintiff is in manufacturing and supply of stationery
products. Upon the request made by the defendant on
22.05.2019 plaintiff supplied stationery to the defendant and
raised an invoice for Rs.6,66,717/- and delivered the same to
the defendant. Against the said invoice, the defendant made
a payment of Rs.45,824/-. Thus, a sum of Rs.6,20,893 was
remained unpaid. Thereafter, on four different occasions the
defendant made payments of Rs.50,000 each in all
Rs.2,00,000/-. Thus, Rs.4,20,893/- was still remained
unpaid. Even after repeated requests and demands, the
defendant did not pay the dues and therefore, the plaintiff
was compelled to issue legal notice dated 29.12.2023
demanding the defendant to pay Rs.4,20,893/- along with
interest. In spite of receipt of notice, the defendant did not
pay the outstanding dues. Therefore, the plaintiff initiated a
pre-institution mediation bearing PIM.No.591/2024 before
the DLSA, Bengaluru. Since, the defendant remained absent,
the DLSA had issued Non Starter Report. The plaintiff,
therefore, filed the present suit for recovery of Rs.4,20,893/-,
along with interest rate of 24% p.a. until filing of the suit in
all Rs.5,08,408/-.
