By way of present petition, order dated 09.04.2025 is put to

challenge. Learned counsel for the petitioners has submitted that

at the initial stage, the petitioners were called for the cross-

examination, whereby, they have turned hostile. It is further

submitted that recalling of them by way of impugned order is not

justified and in support of the said contention, reliance is placed

upon the dictum encapsulated in judgment passed by Hon’ble

Apex Court in Mishrilal and Ors. Vs. State of M.P. and

Ors.2005(2)ACR1744(SC).

Per contra, learned Public Prosecutor has submitted that

charge sheet in the matter is filed relying upon the statements of

present petitioners, as they were the backbone of the present

matter. However, they have turned hostile at a later stage. The

reasons for the same is given in the relevant para of the impugned

order, which is reproduced herein below as under:

Upon perusal of the same, it is noted that learned trial Court

has relied upon the provisions of Section 311 of Cr.P.C and as per

the settled position of law, re-calling of the material witnesses on

account of subsequent development, is permissible to enforce and

administer justice.

Accordingly, the present petition is dismissed. Pending

application(s), if any, also stands disposed of.
