1. Petitioners, through the medium of this petition, have sought
quashment of FIR No. 102/2023 dated 15.11.2023 for the commission of
offences punishable under Sections 376/354/504/506/34 IPC, registered with
Police Station, Khour against the petitioners at the behest of the respondent no.
2, on the grounds that they have been falsely implicated by the complainant
with an intention to compel petitioner no. 1 to marry her on the allegations of
breach of promise of marriage.
2. The learned counsel for the respondent-Union Territory of J&K has
filed the latest status report dated 05.08.2025 in the case formulated by SHO,

CrlM No. 1995/2023
Police Station, Khour stating therein that on investigation no offence has been
made against any of the petitioner Nos.2 to 5 and they have been given the
benefit under Section 169 CrPC. However, as per investigation, the charge-
sheet has been contemplated against the petitioner no.1-Madhu Sadotra, who is
alleged to have committed an offence punishable under Section 376 IPC, which
has been proved during the investigation.
3. Learned counsel for the petitioners at this stage submits that, in view
of the investigation carried out by the investigating agency, the petition may be
disposed of with liberty to the respondent-Union Territory of J&K to lay
charge-sheet before the competent court of law. His statement is taken on
record.
4. In view of the investigation carried out, the present petition is
disposed of with the liberty to the respondent-Union Territory of J&K to lay the
charge-sheet as contemplated.
5. The petitioner no.1, however, shall be at liberty to raise the plea as
raised in this petition, at the time of consideration of the charge sheet against
him before the trial court.
6. Petition is thus disposed of, accordingly, alongwith connected
applications(s). No order as to costs.
