01. This matter is taken up through Hybrid arrangement (video
conferencing/physical mode)
This writ petition has been filed challenging the illegal and
arbitrary actions of the Opp. Parties who are forcibly occupying the
schedule land of the petitioner for construction of road and bridge
without any compensation and settlement payable under Right to
Fair Compensation and Transparency in Land Acquisition
Rehabilitation and Resettlement Act, 2013 and with a prayer to pay
the compensation and damage under Section 26, 27, 28, 29 and 30
of the 2013 Act.
During course of argument the learned counsel for the
petitioner referred to the letter dated 13.11.2023 issued by the
Additional District Magistrate, Revenue, Balasore- Opp. Party No.3

to the Executive Engineer, R.W. Division-II, Balasore- Opp. Party
No. 5 wherein it is mentioned to take necessary action as per the
order of this Court for distribution of compensation and to furnish
action taken report within a week.
The learned counsel submits that in spite of such
communication being made to Executive Engineer, no step has
been taken for which the petitioner has not yet received the
compensation amount.
Let the learned counsel for the State obtain instruction as to
whether any order has been passed by the Executive Engineer,
R.W. Division-II, Balasore pursuance to the communication made
vide letter dated 13.11.2023 of the A.D.M. Revenue, Balasore.
List this matter in the week commencing from 10.02.2025.
