Insurance Act (4 of 1938) , Preamble, S.45— Consumer Protection Act (68 of 1986) , S.21— Life insurance policy – Repudiation of claim – Challenge against – Claim of appellant lodged under life insurance policy taken out by his father was repudiated on the ground of failure to disclose other insurance policies – Insured had made a substantial disclosure since he had disclosed that he had obtained another policy for a higher sum from a private insurer – Policy in question was not a Mediclaim policy but a life insurance cover and death had occurred on account of an accident – Failure to mention about other policies did not amount to a material fact in relation to the policy availed – Repudiation of claim was erroneous.
