This application for bail under Section 483 of BNSS has been
filed by the petitioner who has been arrested in connection with
F.I.R. No.01/2023 registered at Police Station Ramsinghpur,
District Sri Ganganagar for offences under Sections 8/22 and 29
of the NDPS Act and Section 201 of IPC.
Heard learned counsel for the petitioner and learned Public
Prosecutor. Perused the material available on record.
Learned counsel for the petitioner submits that as per the
prosecution story, during routine patrolling, Police allegedly
apprehended co-accused person namely Ram Niwas and recovered
a polythene bag containing 500 tablets of Tramadol, from his
possession. Thereafter, the Police registered a case against the co-
accused and in his disclosure statement, the co-accused person

has stated that the narcotic contraband was supplied to him by
the present petitioner, however, no recovery was made from the
present petitioner and there is no direct evidence of any nature to
implicate him in this case. Moreover, the co-accused person Ram
Niwas has already been enlarged on bail by a Co-ordinate Bench
of this Court vide order dated 12.01.2023 passed in S.B. Criminal
Misc. Bail Application No.401/2023. Learned counsel further
submits that the “Tramadol Tablets” weighing a total of 200 gms
(500 Tramadol tablets in total) recovered in this matter containing
narcotic substance is below commercial quantity. No case of
similar nature is pending against the present petitioner. Learned
counsel for the petitioner has submitted that the petitioner is in
judicial custody since the date of his arrest i.e. 27.05.2025 and
the trial of the case will take sufficiently long time, therefore, the
benefit of bail may be granted to the accused-petitioner.
Per contra, learned Public Prosecutor has opposed the bail
application.
Having considered the rival submissions, facts and
circumstances of the case; taking into consideration the fact that
the recoverd contraband is below commercial quantity; there are
no cases of similar nature pending against the present petitioner;
the co-accused person has already been enlarged on bail by a Co-
ordinate Bench of this Court; without expressing any opinion on
merits/demerits of the case, this Court is inclined to enlarge the
petitioner on bail.
Consequently, the bail application under Section 483 of BNSS
is allowed. It is ordered that the accused-petitioner Mangilal S/o

Phaglu Ram arrested in connection with F.I.R. No.01/2023
registered at Police Station Ramsinghpur, District Sri Ganganagar,
shall be released on bail, if not wanted in any other case, provided
he furnishes a personal bond of Rs.1,00,000/- and two sureties of
Rs.50,000/- each, to the satisfaction of learned trial court, for his
appearance before that court on each & every date of hearing and
whenever called upon to do so till completion of the trial.
