1. Heard learned Counsel for the petitioner and learned

Additional Public Prosecutor for the State.

2. This application, for grant of anticipatory bail, arises out

of Ahiyapur Police Station Case No. 718 of 2024, dated

02.06.2024, disclosing offences punishable under

Sections 343/345/348/385/420/406/467/462/307/120-B/

387/314/376/376(1)/376(2)/377/369/366-A of the Indian

Penal Code.

3. The prosecution case, as per the complaint -cum-First

Information Report, is that co-accused Tilak Kumar Singh

established physical relationship with the complainant/

informant on the pretext of marriage with the help of the

petitioner.

4. Learned Counsel for the petitioner submits that the

petitioner has not committed any offence in the manner

alleged and he has falsely been implicated in this case on

account of the fact that the petitioner is the Director of

D.B.R. Unique Company, having its head office at

NOIDA. The company deals in the ayurvedic medicines

and cosmetic goods and training of sales and marketing

personal. The complainant was working with the co-

accused Tilak Kumar Singh, who was a distributor of the

company. There is no allegation against the petitioner that

he established physical relationship with the complainant/

informant.

5. Regards being had to the submissions advanced on behalf

of the parties and taking into consideration the fact that

there is no allegation of establishing physical relationship

against the petitioner and the petitioner is the Director of

the Company, of which co-accused Tilak Kumar Singh

was a distributor, I am inclined to grant the petitioner

privilege of anticipatory bail.

6. This application is, accordingly, allowed.

7. Let the petitioner, above named, in the event of his arrest

or surrender before the Court below within a period of

four weeks from today, be released on bail on furnishing

bail bond of Rs. 10,000/- (ten thousand) with two sureties

of the like amount each to the satisfaction of learned

Exclusive Special Court, POCSO 03, Muzaffarpur, in

connection with Ahiyapur Police Station Case No. 718 of

2024, subject to the condition laid down under Section

438 (2) of the Code of Criminal Procedure.
