Instant revision petition has been filed by the petitioners

against the order dated 09.03.2021, passed by learned Additional

Sessions Judge No.1, Nagaur in Sessions Case No.28/2020,

whereby learned trial court framed the charges against the

petitioners for offence under Sections 341, 342, 365, 323/34,

325/34, 307/34 IPC.

Learned counsel for the petitioners submits that according to

the injury report of injured Sitaram, he received total seven

injuries, out of which injuries No.1 & 2 are grievous injuries, but

they were found on the non-vital parts of the body of the injured.

Counsel further submits that though the injury No.5 was caused

[2025:RJ-JD:33704] (2 of 3) [CRLR-403/2021]

on the head of the injured, but it was found to be simple in

nature. Thus, upon a comprehensive analysis of the statements of

the injured and other witnesses of the incident as well as from

injury report, offence under Section 307 IPC is not made out

against the petitioners. Therefore, it is prayed that the impugned

order to the extent of framing charge for offence under Section

307/34 IPC against the petitioners, being per se illegal, may be

quashed and set aside.
