2. In this writ petition, the petitioner has prayed for direction upon the
respondents to proceed in accordance with law by taking an appropriate and quick
action in the matter arising out of Parsudih P.S. Case No. 102 of 2024 under Sections
120B, 201, 323, 341, 379, 380, 386, 392, 448, 452, 504, 506 and 34 IPC, pending in
the Court of learned ACJM, Jamshedpur, and also for a direction upon the respondents
to investigate the matter and thereby to take appropriate action against respondent
Nos. 7 to 14.
3. Counsel for the petitioner submits that through the petitioner has filed a
complaint, which was sent under Section 156(3) Cr.P.C to register the FIR, but the
police is not investigating the case. He submits that the police is taking the side of the
accused persons. He submits that suffice it would be if a direction is given to the
respondents to properly investigate the occurrence and submit the final report or
charge-sheet before the Court concerned.
4. Counsel for the State submits that without any delay the investigation will
be concluded and report will be submitted before the Court.
5. An FIR has already been lodged and it is duty of the Investigating Officer
to investigate the offence.
6. Considering the aforesaid submission, I direct the Investigating Officer to
conclude the investigation of Parsudih P.S. Case No. 102/2024 at the earliest and
submit a report before the Court concerned. The Supervising Authority will also
supervise the investigation and will ensure that without delay, final report is submitted
before the Court.
7. So far as taking action against respondents is concerned, since an FIR
has already been registered, it is on the I.O to take proper action. This Court cannot
direct the I.O either to arrest or not to arrest the accused. The same will depend upon
the facts of this case and the situation which necessitate the arrest of the accused.
8. Accordingly, this writ petition is disposed of with direction to conclude the
trial at the earliest.
