In the instant petition, petitioner has alleged non-compliance of order
dated 27.04.2022, wherein it was directed that the Deputy Commissioner,
Kupwara, shall constitute a team of officers headed by Assistant
Commissioner, Revenue, to demarcate the entire State/Kahcharie land
existing in the village Hyhama and to proceed to evict the unauthorized
occupant, only after receiving the report from the demarcation team. The
Deputy commissioner, was further directed to submit a report to this Court
with regard to the demarcation made in the village and the eviction ordered.
It was also emphasized that before evicting any person under occupation, an
opportunity of being heard shall be given.
Upon issuance of notice, statement of facts has been filed by the
respondents, wherein it is stated that the Deputy Commissioner, Kupwara in
compliance with the order dated 27.04.2022, constituted a team of officers
headed by Assistant Commissioner Revenue, Kupwara, vide order dated
19.05.2022. The Committee so constituted submitted a demarcation report of
entire State/Kahcharie land of village Hyhama.
Subsequent to the submission of the said report, the Deputy
Commissioner, Kupwara, issued eviction notice to the illegal occupants,
which were duly served upon them by his office on 24.11.2022 and
05.12.2022, affording them an opportunity of being heard.

In view of the compliance report filed by the respondents, it is evident
that the order passed by this Court dated 27.04.2022, stands complied with
in its letter and spirit.
Accordingly, this contempt petition stands disposed of and the
contempt proceedings initiated against the respondents are closed.
