The Court made the following order:

1. This criminal petition is filed under section 528 of the

Bharatiya Nagarik Suraksha Sanhita, 2023 [for short

‘B.N.S.S.’] seeking to quash the proceedings in C.C.

No.683 of 2024 on the file of I Additional Judicial

Magistrate of First Class, Tadepalligudem.

2. The learned counsel for the petitioners submits that the

petitioners 1 and 2 are the father and mother of A.1.

Petitioner No.3 is the sister of A.1. The de facto

complainant and A.1 were married and certain disputes

arose during their marital life. Thereafter, the 2nd

respondent has filed a complaint against A.1 and the

petitioners herein, and the same was registered as a

case in Cr.No.305 of 2024 under Section 498-A read with

34 I.P.C. and Sections 3 and 4 of Dowry Prohibition Act.

The police have filed a charge sheet and the same was

taken on the file and the same was numbered as

C.C.No.683 of 2024 on the file of I Additional Judicial

First Class, Tadepalligudem.

3. Considering the submissions of the learned counsel for

the petitioners that the petitioners are staying separately

and have no role insofar as the marital disputes between

A.1 and the 2nd respondent, this Court deems it

appropriate to dispense with the presence of the

petitioners/A.2 to A.4 in C.C. No.683 of 2024 on the file of

the I Additional Judicial First Class Magistrate,

Tadepalligudem, subject to the petitioners filing an

undertaking to appear before the I Additional Judicial First

Class Magistrate, Tadepalligudem, as and when required.

4. With these observations, the criminal petition is disposed

off.

5. Miscellaneous petitions, if any, pending in this criminal

petition shall stand closed.
