3. The present petition has been filed challenging the impugned
withdrawal order dated 31st May, 2025 passed by the National Council for
Teacher Education (hereinafter “NCTE”). Vide the impugned order the
recognition given to the Petitioner School has been withdrawn for the course
being D.El.Ed., with effect from the academic session 2025-26.
4. Ld. Counsel for the Respondent submits that under Section 18 of the
National Council for Teacher Education Act, 1993, the impugned order is an
appealable order. The said provision is set out below:

“18. Appeals.– (1) Any person aggrieved by an order
made under section 14 or section 15 or section 17 of the
Act may prefer an appeal to the Council within such
period as may be prescribed.
(2) No appeal shall be admitted if it is preferred after
the expiry of the period prescribed therefor: Provided
that an appeal may be admitted after the expiry of the
period prescribed therefor, if the appellant satisfies the
Council that he had sufficient cause for not preferring
the appeal within the prescribed period.
(3) Every appeal made under this section shall be made
in such form and shall be accompanied by a copy of the
order appealed against and by such fees as may be
prescribed.
(4) The procedure for disposing of an appeal shall be
such as may be prescribed: Provided that before
disallowing an appeal, the appellant shall be given a
reasonable opportunity to represent its case.
(5) The Council may confirm or reverse the order
appealed against”
5. It is noted by the Court that similar matters have already been listed
before this Court, including W.P.(C) 8459/2025 titled ‘Dr Jai Mangal Singh
Prathmik Prashikshan Sansthan v. National Council for Teacher
Education & Anr.’ The relevant paragraphs of the order dated 18th June,
2025 passed in the said matter is extracted hereunder:
“5. Various grounds are asserted by the ld. Counsel for
the Petitioner. Ld. Counsel for the Petitioner relies upon
the order passed by the Co-ordinate Bench of this Court
in W.P.(C) 7008/2025 titled ‘Ram Krishna College v.
National Council for Teacher Education & Anr.’ dated
22nd May, 2025 where under similar circumstances, theThis is a digitally signed order.

Court has granted interim relief to the Petitioner.
6. Considering the order which has already been passed
in Ram Krishna College (Supra), list this matter before
the Roster Bench on 8th July, 2025.
7. The Petitioner, in the meantime, may commence the
counselling sessions for the academic year 2025-2026.”
6. Considering the fact that similar orders have already been passed by
this Court, the Petitioner may commence the counselling sessions for
academic session 2025-26. However, any admissions made shall be subject to
the outcome of this writ petition.
7. List before the Roster Bench on 08th July 2025.
