01. The petitioners have challenged order dated 11.02.2025 passed by

learned Chief Judicial Magistrate, Poonch, whereby they have been impleaded as

accused in a case arising out of FIR No.247/2022 for offences under Section

382/147/323 IPC registered with Police Station, Poonch.

02. Learned counsel for the petitioners submits that the impugned order

passed by the learned Magistrate is cryptic in nature as no reason muchless a

cogent reason has been assigned by the learned Magistrate while impleading the

petitioners as the accused. It has been further submitted that as many as on two

occasions, the allegations made in the impugned FIR were thoroughly

investigated by the Investigating Agency and on both the occasions, the

involvement of the petitioners in the alleged occurrence was not established but

in spite of this, the learned Magistrate has impleaded the petitioners as the

accused.

03. Issue notice to the respondents.

04. Mr. Eishaan Dadhichi, learned GA waives notice on behalf of

respondent No.1.

05. Notice be sent to respondent No.2 through the concerned Police

Station.

06. List on 02.07.2025.

07. Meanwhile, proceedings pending before the learned Chief Judicial

Magistrate, Poonch to the extent to the petitioners shall remain stayed.
